These Terms & Conditions (Terms) govern the provision of voice training services by Make Loud Noise, operated by Anita Marie Martin ABN 72 956 022 974 (Make Loud Noise, we, us, our) to you as a client (you, your).

1. Your Contract

Your contract with Make Loud Noise consists of:

By booking or using Make Loud Noise services, you agree to all of these documents in their entirety. If you do not agree, you must not use our services.

2. Changes to Terms

We may change these Terms at any time by:

  • Posting updated versions on this page

  • Providing notice via email to the address associated with your account

If you continue to use services after the notice period, you will be deemed to have agreed to the changes. For changes that benefit you or are required by law, we may make changes effective immediately. For all other changes, we will provide reasonable notice.

It is your responsibility to regularly review these Terms for updates.

3. Booking & Payment

  • 3.1 Prepayment Required
    All services must be paid for in full and in advance before services are rendered. Payment constitutes acceptance of these Terms.

  • 3.2 Monthly Terms
    If you book lessons on a monthly term basis, the full term must be paid in advance. Monthly terms roll on a monthly basis.

  • 3.3 Payment Methods
    We accept payment via Square. You authorise Make Loud Noise to keep payment details on file and automatically charge for services as invoiced. Cash not accepted.

  • 3.4 Non-Payment
    Non-payment for services rendered constitutes theft and will be referred to the appropriate authorities. We reserve the right to suspend all services immediately for non-payment and pursue debt recovery, including legal costs and collection agency charges.

  • 3.5 Travel & Leave Policy

    • If you are travelling or taking leave and wish to hold your regular lesson spot, you must:

    • Notify Make Loud Noise of your travel dates in advance.

    • Prepay for sessions occurring within 30 days of your travel period return

    • Failure to prepay for sessions during your absence will result in your lesson spot being released to other clients. Make Loud Noise is not obligated to provide your preferred time slot upon your return.

  • 3.6 No Reschedules or Credits
    There are no reschedules, credits, or transfers of prepaid sessions to future terms. If you are absent for any reason, prepaid fees are non-refundable.

  • 3.7 Retainer vs. On-Demand Rates

    • Retainer Rate (Recurring): Reserved for clients committed to a regular weekly or fortnightly schedule. This rate secures your specific time slot. If you cancel your retainer, your spot is released immediately.

    • On-Demand Rate (Casual): Applies to one-off sessions, emergency vocal repair, or irregular bookings. These are charged at a premium rate and are subject to the Director's availability.

    • Rate Changes: Moving from a Retainer to an On-Demand status requires two weeks' written notice.

4. No Refunds Policy

  • 4.1 No Refunds: All payments are final and non-refundable. This includes but is not limited to:

    • Missed sessions for any reason (illness, travel, personal circumstances, traffic, technical difficulties)

    • Partial completion of a term

    • Change of mind

    • Dissatisfaction with services

    • Early termination by the client

  • 4.2 No Exceptions: There are no credits, reschedules, or transfers under any circumstances. By booking services, you acknowledge and accept this policy.

5. Annual Price Increases

Make Loud Noise reserves the right to adjust service prices annually to account for inflation, quality improvements, and business costs.

Price changes will take effect:

  • For monthly term clients: 30 days after written notice via email

  • For prepaid terms: at the time of next term renewal

You will be notified of price changes via email to the address associated with your account. Continued use of services after the notice period constitutes acceptance of the new pricing.

If you do not wish to continue at the new pricing, you must cancel services at least 2 weeks prior to the effective date of the price increase, in accordance with the lesson Termination Policy.

6. Lesson Termination

  • 6.1 Termination by Client: If you wish to terminate your lessons, you must provide two weeks' written notice via email to adios@makeloudnoise.com.

    Failure to provide two weeks' notice will result in a fee equivalent to two weeks of lesson fees being charged to your account, payable before any future services can be accessed.

  • 6.2 Termination by Make Loud Noise: Make Loud Noise reserves the right to terminate services immediately without refund if you:

    • Violate any Make Loud Noise policy (Terms & Conditions, Service Terms, Acceptable Use Policy, Privacy Policy, Student Rights & Responsibilities)

    • Engage in harassment, threatening behaviour, or abusive conduct.

    • Fail to pay for services.

    • Provide false or misleading information.

    • Engage in any conduct deemed unsafe or inappropriate.

    • Discovery of a conflict of interest regarding suitability to be around minors, or failure to disclose legal restrictions as required by our Community Safety & Suitability Declaration.

    • Make Loud Noise reserves the right to refuse service to anyone, at any time, for any reason.

7. Liability & Disclaimers

  • 7.1 Service Provision: Make Loud Noise will use reasonable endeavours to provide services as described. We do not warrant that services will be uninterrupted, error-free, or free from technical difficulties.

  • 7.2 Not Medical Services: Make Loud Noise provides voice training services only. We are not medical doctors, speech pathologists, or mental health professionals. Any advice provided is general guidance only and must not replace professional medical care.

  • 7.3 Vocal Risk: You acknowledge that voice training, particularly extreme vocals and high-performance singing, carries inherent risk of vocal injury. Make Loud Noise is not liable for vocal damage resulting from:

    • Your failure to follow instructions

    • Unsafe vocal practices outside of sessions

    • Substance abuse

    • Pre-existing vocal conditions

    • Failure to seek appropriate medical care when advised

  • 7.4 Limitation of Liability:

  • To the maximum extent permitted by law, Make Loud Noise and Anita Marie Martin are not liable for:

    • Any indirect, special, or consequential loss or damage

    • Loss of income, revenue, or business opportunities

    • Loss of or damage to data

    • Any loss or damage caused or contributed to by your negligence, breach of contract, or failure to follow instructions

    • Any claim made 6 months or more after the circumstances giving rise to the claim first became known or could reasonably have become known.

    • Make Loud Noise's total aggregate liability for any loss or damage is limited to the amount you paid for services in the 12 months preceding the claim.

  • 7.5 Australian Consumer Law: Nothing in these Terms excludes or limits rights you may have under the Australian Consumer Law that cannot be excluded or limited by law.

8. Indemnification

You agree to indemnify and hold harmless Make Loud Noise and Anita Marie Martin from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your breach of these Terms or any Make Loud Noise policy.

  • Your violation of any third-party rights (including intellectual property rights)

  • Your use of Make Loud Noise services, website, or social media

  • Any content you create, share, or distribute in connection with services.

  • Your negligence or wilful misconduct

  • Any false or misleading information you provide

This indemnification survives termination of your contract with Make Loud Noise.

9. Governing Law & Disputes

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or Make Loud Noise services will be subject to the exclusive jurisdiction of the courts of Queensland.

If a dispute arises, you agree to first attempt to resolve it by contacting Make Loud Noise directly at next@makeloudnoise.com before pursuing legal action.

10. General Provisions

  • 10.1 Fantasy Clause

    At Make Loud Noise, we are committed to supporting your vocal journey. If you express a desire to excel at vocal arts, we ask that this be matched with effort and engagement. In the spirit of the saying 'willingness without action is fantasy,' we may discuss your commitment if progress stalls, and continued participation will require demonstrable steps toward your goals. If improvement is not seen within 3 lessons after the Director raises this issue, lessons will be terminated.

  • 10.2 No Fraternisation Policy

    To maintain a supportive and professional learning environment, personal or intimate relationships outside the scope of vocal work between Anita Marie Martin and students are not appropriate. Our roles are those of Music Industry Professional and student, and it is important these remain professional and focused on your vocal development. Requests for social or personal involvement outside of lessons will be gently declined.

  • 10.3 Minors/Parental Consent
    Clients under 18 must have a parent or legal guardian provide written consent to participate in services. All communication and session arrangements for minors will be conducted with parental involvement and supervision.

  • 10.4 Notices
    Any notice required under these Terms may be sent by email, post, or phone/text. Notices sent by email are deemed delivered upon receipt confirmation. Notices sent by post are deemed delivered 5 business days after posting.

  • 10.5 Assignment
    You may not assign your rights or obligations under these Terms without Make Loud Noise's written consent. Make Loud Noise may assign this contract to any successor in connection with business reorganisation, merger, acquisition, or sale of assets.

  • 10.6 Severability
    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

  • 10.7 Entire Agreement
    These Terms and the documents referenced herein constitute the entire agreement between you and Make Loud Noise and supersede all prior arrangements or understandings.

  • 10.8 Force Majeure:
    Neither party shall be liable for failure or delay in performing obligations under these Terms due to causes beyond reasonable control, including but not limited to natural disasters, acts of government, pandemic, or other events of force majeure.

  • 10.9 Third-Party Services
    Make Loud Noise is not responsible for the performance, privacy, or security of third-party platforms (such as Zoom, Google Drive, Dropbox) used in service delivery.

  • 10.10 Feedback & Complaints
    If you have concerns, feedback, or complaints about services or policies, please contact Make Loud Noise as outlined in Section 11. We aim to respond to formal complaints within 5 business days.

11. Minors (Under 18s) & Vulnerable People Policy

Child protection requirements 

As a business whose activities at times include children less than 18 years of age or children of adults engaging in our services we must comply with current legislation regarding Working with Children, including blue card requirements and risk assessments. Refer to http://www.bluecard.qld.gov.au for further information about the 10 Child Safety Standards. 

As the music, creative, and performing arts are a field of industry primarily occupied by adults when defined by professional employment, income generation, and career longevity, all Make Loud Noise activities are broken up into six categories by age:

  • Adults being age 25 and over

  • Young Adults being age 18 - 24 years

  • Youth being age 12 - 17 years

  • Children age 5 - 11 years

  • Young Children birth to 4 years

  • All ages

11.1 Leadership
The Director of Make Loud Noise is solely responsible for the implementation and oversight of child-safe practices as a Sole Trader. She leads by example, ensuring that every professional decision prioritises the safety, agency, and vocal health of the minor. We maintain an active Blue Card, have a clear Police Check, and a "Zero Tolerance" culture that is communicated clearly to all industry peers and facility co-tenants.

11.2 Voice of Children
We respect the minor as a professional artist. We encourage youth clients to participate in the design of their own vocal goals and to speak up if they feel physically or emotionally uncomfortable. Their feedback is a core component of our continuous improvement, ensuring the work we engage in is always commensurate with their developmental stage.

11.3 Family and Community
We view the parent/guardian as an essential partner in supporting the young artist. We maintain open, transparent lines of communication with families and provide them with the tools and data (including session recordings) to be active participants in the minor’s vocal journey.

11.4 Equity and Diversity
Make Loud Noise is a space of radical inclusion. We pay particular attention to the needs of Aboriginal and Torres Strait Islander youth, LGBTQIA+ students, and those with neurodivergence or disabilities. We ensure that our science-informed approach is adapted to respect the individual cultural and personal identity of every young performer.

11.5 People
The Director is the sole provider of services and maintains a current, valid Blue Card. Any future staff or contractors will undergo rigorous screening, including background checks and interviews focused specifically on their commitment to Child Safe Standards, before being allowed into the laboratory environment.

11.6 Complaints Management
We take all concerns seriously. If a minor or parent has a complaint regarding safety or conduct, it must be reported to next@makeloudnoise.com. We commit to acknowledging receipt within 24 hours and conducting a transparent review. We will not penalise or "ignore" any individual for raising a safety concern.

11.7 Knowledge and Skills
The Director undergoes ongoing professional development in vocal science, performance, production, song writing, mental health, vocal health, music industry business, and Child Safe legislation. We ensure that our youth clients and their parents are educated on their rights and the "Student Rights & Responsibilities" document during their initial induction.

11.8 Physical and Online Environments

  • 11.8.1 At Make Loud Noise it is our policy that the physical environment be fitting the students age and development while also respecting the land owners relationship with Child Safety. For example: The recording facilities at The Edge State Library or the Moreton Bay Council or rehearsal spaces at Visible Ink are happy to host minors providing their parent or guardian is on site, however an industry based recording studio or rehearsal studio may chose to provide an adults only space. While both might fit the developmental needs of the student (needing to use a Personal Amplification System and Microphone) only the age appropriate spaces can be used, The changes implemented on the 1st April 2026 altered the availability of environmentally and developmentally appropriate spaces for Make Loud Noise to work out of. As such, in most instances it is safer for youth to have online sessions.

  • 11.8.2 Online sessions are recorded via Zoom or another third party service and are stored securely in the cloud. Parents/Guardians and children have access to the youth’s session recordings. For under 16's Parents/Guardians must be in the same location with the child and the room to the door they are having a session in be open. For some over 16's with independence a waiver can be signed by the Parent/Guardian granting permission for the minor to be allowed to attend the session remotely on their own while a Parent/Guardian is not present.

11.9 Continuous Improvement
We do not treat safety as a "tick-box" exercise. Following the legislative changes of 1 April 2026, we conduct bi-annual reviews of our risk assessments and physical/digital protocols. We adapt our "Praxis" based on new forensic data and changes in the Queensland child safety landscape.

11.10 Policy and Procedures
All child-safe policies are documented, accessible, and form a mandatory part of the Client Contract. We ensure that our procedures for online sessions, recording storage, and communication are strictly followed to prevent any "grey areas" in professional conduct.

11.11 Universal Principle and Cultural Safety
We acknowledge the Traditional Owners of the land on which we work. We are committed to providing a culturally safe environment where Aboriginal and Torres Strait Islander children feel respected and supported. We recognise that cultural safety is an integral part of an artist's ability to "paint with their voice freely."

11.12 Legal Consent
A parent or legal guardian must provide written consent via our mandatory contract before any services are rendered.

11.13 Communication & Point of Contact
To comply with Australian Child Safety Standards and our Blue Card obligations, the parent or legal guardian is the only authorised point of contact for all administrative, financial, and logistical matters. The Director will not engage in private messaging, social media contact, or one-on-one digital communication with a minor. All digital communication must include the parent/guardian.

11.14 Duty of Care & Mandatory Reporting
As a Blue Card holder, the Director operates under Queensland's mandatory reporting requirements. Confidentiality does not apply if a minor discloses information that suggests a risk of harm to themselves or others.

11.15 Professional Boundaries
We do not provide "child care." If a minor's behaviour is deemed unsafe or consistently disruptive to the professional environment, services will be terminated in accordance with our standard termination policy.

11.16 Community Safety & Suitability Disclosure:

  • 11.16.1 Make Loud Noise is a Blue Card-compliant, child-safe environment. We do not provide services to individuals subject to legal restrictions or criminal histories (including Blue Card disqualification) that make them unsuitable to be in professional or community environments where minors are present. Providing false information or failing to disclose such a conflict is grounds for immediate termination of all services and a permanent ban from the Studio without refund.

  • 11.16.2 Make Loud Noise maintains a zero-tolerance policy toward domestic violence, sexual assault, and harassment. We do not provide services to individuals with a history of such conduct. Disclosure of any legal findings, orders, or active proceedings related to these matters is mandatory. Discovery of such a history will result in immediate termination of all services without refund.

12. Shared Facility & Personal Property Disclaimer

  • 12.1 Third-Party Facility: You acknowledge that services are provided within a shared multi-use building operated within the Music Industry. Make Loud Noise does not control, and is not responsible for, the conduct of other tenants, visitors, or staff of the third-party facility.

  • 12.2 Personal Belongings: You are responsible for your own personal property (instruments, bags, electronics) at all times. Make Loud Noise and Anita Marie Martin are not liable for the loss, theft, or damage of personal belongings in the shared spaces or within the Studio suite.

  • 12.3 Studio Events: During community-wide events (e.g., "Random Acts of Loudness"), the "Shared Space" rule remains in effect. Attendees are responsible for their own safety and property while navigating the building.

13. Zero Tolerance Policy

Make Loud Noise maintains a zero-tolerance policy toward domestic and family violence, sexual assault, and harassment. We do not provide services to individuals with a history of such conduct or active legal findings/orders (e.g., DVO/ADVO). Providing false information regarding your legal history is a material breach of contract and will result in immediate termination without refund.

14. Emergency Contact

  • 14.1 Mandatory Provision: It is a condition of service that all clients provide a valid emergency contact name and phone number.

  • 14.2 Usage: This information will only be accessed in the event of a medical emergency, a safety incident, or a serious breach of the Studio's Duty of Care.

  • 14.3 Updates: Clients are responsible for ensuring this information is accurate and updated via the client portal.

15. Facility Compliance

  • 15.1 Shared Governance: Make Loud Noise operates within Music Industry spaces and complies with all facility-wide safety and behavioural standards.

  • 15.2 Facility Bans: If a client is banned, trespassed, or restricted from the Music Industry premises by facility management for any reason, Make Loud Noise is unable to fulfil service delivery.

  • 15.3 Termination: A ban from the Music Industry facility constitutes a material breach of these Terms. In such an event, services will be terminated immediately with no refund, credit, or transfer of fees.

16. Methodology: Spiritus, Praxis, Artis

  • 16.1 Core Pillars: The Make Loud Noise system is based on Spiritus (Breath and Intent), Praxis (Consistent, disciplined practice), and Artis (The craft and performance).

  • 16.2 Requirement of Participation: These three pillars are not optional suggestions; they represent the architectural framework of our training.

  • 16.3 System Compliance: Active engagement with the full system is required for continued enrolment of Music Industry Professionals. Consistent failure to apply the Praxis (practice) or Spiritus (technical intent) components of the system may lead to a review of your enrolment and potential termination under the Fantasy Clause (Section 10.1).
