1. Scope & Purpose
This policy outlines the administrative standards for data collection, storage, and processing for Make Loud Noise. We operate under the Australian Privacy Principles (APPs).
2. Information Collection & Identity Verification
To maintain the security of the Studio and prevent unauthorised access or abuse, we collect:
Identity Data: Name, contact details, and where necessary for safety, government-issued identification.
Technical Data: IP addresses and device info for secure Square transactions.
Service Data: Lesson recordings and notes, maintained as a record of professional service delivery.
Unauthorised visits or attempts to access the Studio outside scheduled appointments will result in immediate service termination and may be reported to authorities.
3. Legal Basis for Processing
We process your data to:
Execute the Service Agreement: Fulfilling your booking and providing technical training.
Protect Legitimate Interests: Monitoring for abuse, ensuring the safety of the Director, and protecting the reputation of the Studio.
4. Data Retention & Security
Billing Records: Maintained for 7 years per Australian regulatory requirements.
Service Records: Lesson recordings are retained as a "Proof of Delivery" for 12 months unless otherwise requested.
Security: Data is housed in SSL-encrypted environments provided by Squarespace, Google, and Square. The Studio does not store raw credit card data.
5. Acceptable Use & Suspension
Data collection and identity verification are prerequisites for service. Make Loud Noise reserves the right to refuse service to anyone, at any time, for any reason. Failure to provide accurate information, violation of the Studio's Acceptable Use Policy, or behaviour deemed threatening or inappropriate will result in immediate Administrative Suspension and permanent termination of access.
6. Intellectual Property
All lesson recordings, materials, methodologies, and proprietary techniques remain the intellectual property of Make Loud Noise and Anita Marie Martin. Recording, reproduction, or distribution of lesson content without explicit written consent is prohibited and constitutes breach of service agreement.
7. Confidentiality & Studio Privacy
All clients are bound by strict confidentiality regarding:
The identity of other clients using Studio services
Any music, lyrics, techniques, or creative content observed or overheard during Studio visits
Proprietary methodologies, exercises, and teaching materials used by Make Loud Noise
Recording, photographing, or sharing any aspect of Studio operations, client presence, or lesson content on social media or any public platform is strictly prohibited without explicit written consent from Make Loud Noise and any affected parties.
Breach of confidentiality will result in immediate service termination, forfeiture of any prepaid fees, and may result in legal action for damages.
Make Loud Noise maintains reciprocal confidentiality regarding client identities and session content, except where required by law or with client consent.
Access to Records Following Death
In the event of a client's death, lesson recordings and service records may be released to the deceased's legal estate representative upon provision of:
Death certificate
Proof of legal authority (Grant of Probate, Letters of Administration, or statutory declaration of relationship and estate management pending formal grant)
Written request including: executor/administrator's full name and contact details, deceased's full name and date of birth, specific records requested and purpose
Requests must be submitted in writing via email to privacy@makeloudnoise.com with all supporting documentation.
8. Mandatory Disclosure & Duty of Care
Make Loud Noise operates under a duty of care to all clients and the broader community. Confidentiality does not extend to situations where disclosure is legally required or necessary to prevent harm.
We are required to disclose information to appropriate authorities when:
A client discloses intent to harm themselves or others
Child abuse or neglect is disclosed or suspected
Elder abuse is disclosed or suspected
A client discloses involvement in serious criminal activity
Required by court order or law enforcement
Mental Health First Aid Accreditation: The Director holds Mental Health First Aid accreditation. This is NOT a counselling or therapy service. Clients requiring mental health support will be referred to appropriate qualified professionals.
Studio Boundaries: Make Loud Noise is a voice training service, not a therapeutic or counselling service. Clients seeking to discuss mental health crises, trauma, or personal distress beyond the scope of voice training will be redirected to appropriate support services.
